A twisted paternity case in the UK involving a woman, identical twin brothers, and a child has drawn attention after a recent update in the ongoing legal battle over paternal responsibility.
The case centered around questions of paternity, legal recognition, and the role of DNA testing in the complex situation.
As judges revisited earlier decisions, the latest ruling has brought the matter back into focus and prompted reactions from viewers.

In the case that has reached the Court of Appeal in London, one twin had already been listed as the father on the child’s birth certificate, but the mother and the other twin challenged that decision.
However, the judge ruled that DNA testing cannot determine which brother is the biological father, per Sky News.

Sir Andrew McFarlane stated that while testing confirmed one of the twins is the father, “it is not possible to say which.”
He further noted that identical twins share nearly identical DNA, making it impossible for standard tests to distinguish between them.

Also, Judge Madeleine Reardon had earlier found that both brothers had a relationship with the woman “within four days of each other” during the time the child was conceived. As a result, it is “equally likely” that either could be the father.

The court also addressed the issue of the birth certificate. While one twin had previously been registered as the father, the judge ruled that he was “not entitled” to be listed, given the uncertainty.
As a result, his parental responsibility has been removed for now as the case continues.

At the same time, the court refused to declare that the other twin is the father, making it clear that neither man can currently be legally confirmed as the child’s parent.
McFarlane explained the situation, adding, “The failure to prove a fact means that that fact is not proved—it does not mean that the contrary is proved.”

“There is a distinction between something being not proven, and making a positive declaration that the fact asserted is not true.”
He also noted that it is “not in P’s welfare interest” (the child is referred to as ‘P’ in the court documents) for the uncertainty to continue. McFarlane emphasized that a lower court will now decide whether one, both, or neither of the twins should have parental rights moving forward.

The core issue why DNA testing cannot solve the case is the limits of current science.
Because identical twins come from the same fertilized egg, their DNA is almost identical.
This also means that while a paternity test can confirm that one of them is the father, it cannot identify which one.
As McFarlane said, “It is possible, indeed likely, that by the time P reaches maturity, it may be possible for science to identify one father and exclude the other twin, but, for the coming time, that cannot be done without very significant cost, and so her ‘truth’ is binary and not a single man.”
