A 25-year-old model is seeking a restraining order against fitness influencer Bradley Martyn following an alleged confrontation at a Halloween party in Los Angeles.
Noelle Leyva claimed the 37-year-old fitness personality physically attacked her during the October 29 gathering, leaving her frightened enough to seek legal protection.
However, Martyn has strongly denied her accusations, and his lawyer has accused her of trying to extort money from him.
A model accused a fitness influencer of hitting and pushing her at Halloween party
According to Levya’s court filing, the alleged incident took place on October 29 at a crowded Halloween party in Los Angeles.
She claimed that another woman at the gathering called her over to talk. When Levya approached, she realized that Martyn was speaking with the woman.
Levya alleged that the influencer immediately became hostile when he noticed her.
“As soon as he saw me, he said, ‘F—k off you stupid wh—e’ and hit me across the chest and pushed me onto the ground,” she wrote in the application obtained by the California Post.
The model said the alleged a**ault did not leave any visible marks on her body. However, she claimed the incident left her frightened and emotionally shaken.
In her filing, Leyva described herself as “scared, anxious and fearful for my life.”
She also said she felt humiliated by what happened and wanted legal protection from Martyn.
Levya’s court application further described a history of tension between her and Martyn
Levya claimed she first met Martyn around five years ago, when she was 20, and he was 32.
According to the court filing, he offered to help her become more famous and make more money.
Leyva said they later entered into a business arrangement. However, she eventually left the partnership in 2023.
She alleged that Martyn held a grudge against her after their professional relationship ended. According to her filing, he told friends and acquaintances that he wished she were d**d because of “what I did to him.”
Leyva said she initially did not take the alleged threats seriously.
“I did not take his threats for my life seriously,” she wrote, adding that after the alleged October 29 encounter, “I am scared, anxious and humiliated.”
The filing also states that Martyn sued her after she left their business arrangement. However, he reportedly dismissed the case in May 2023.
Apart from Levya, her boyfriend also submitted a statement with the restraining order request
Several people reportedly provided sworn statements to the court, including her boyfriend, Colin Hughes, who claimed he witnessed the confrontation.
Hughes alleged that Martyn forcefully pushed Leyva, causing her to fall on the stairs.
“Bradley forcefully shoved Noelle, causing her to fall to the ground on the stairs,” he wrote.
He also claimed that Leyva had not physically provoked Martyn before the alleged incident.
“Noelle had not physically provoked Bradley or done anything to warrant such an aggressive response,” Hughes stated.
He then highlighted the difference in their physical sizes, saying that the encounter was particularly frightening to witness.
“Bradley is approximately 6’3” and weighs 260 pounds, while Noelle is approximately 5’4” and weighs 100 pounds. Given the significant difference in their physical size and strength, witnessing Bradley forcefully push Noelle to the ground was extremely alarming and frightening.”
Leyva is asking the court to impose several restrictions on Martyn.
She wants him to stay at least 50 yards away from her, her home, workplace, and vehicle. She has also asked the judge to prevent him from speaking negatively about her on social media, either directly or through other people.
In her application, she asked the court to bar Martyn “from vilifying me, directly or through his proxies, on social media for filing this petition and post negative commentary about me, my life and my friends.”
“Mr. Martyn has a big presence on social media,” she wrote. “He has over 4 million followers on Instagram alone.”
Following the allegations, Bradley Martyn denied the accusations and called the request an attempt to extort him
Martyn has strongly rejected Leyva’s account of the October 29 incident.
His attorney, Charles Lew, stated to The New York Post on Friday that the fitness influencer disputed her claims.
“Bradley Martyn categorically disputes Ms. Leyva’s account of what occurred on October 29,” Lew said.
Multiple witnesses who were present will corroborate Mr. Martyn’s account,” he added.
Lew further accused Leyva of using the restraining order request to pressure his client for money.
“This is another ill-advised and duplicitous attempt to extort money from my client, and we will respond accordingly,” the attorney stated.
Martyn’s legal team has therefore made it clear that it intends to challenge Leyva’s claims.
The allegations have also sparked strong reactions online, with some people expressing support for Leyva
One commenter wrote, “I’m not trusting any man that wears a beanie like that,” while another responded, saying, “I don’t trust girls with lips like that either.”
Some users also brought up a previous incident involving Martyn and a young person who reportedly took his hat.
“I remember he also slapped the sh*t out of that kid that took his hat. That kid obviously deserved a slap, but this guy has trouble controlling his anger,” one person commented.
Others were more direct in their criticism.
“This guy looks like he’ll get violently angry over a baby crying,” another user wrote.
One commenter also questioned how Martyn might come across in court, saying, “I don’t want to judge a book by its cover but… let’s just say he won’t have a whole lot going for him in the courtroom.”
